1. About these terms

These terms apply to your use of webnday.com and to services provided by Webnday LLC ("Webnday", "we", "us"), a Limited Liability Company with a business address at 5900 Balcones Dr Ste 23723, Austin, TX 78731, United States of America.

By using this website you accept these terms. Where we carry out work for you, these terms apply alongside the written scope agreed for that project. If the two ever disagree, the written scope for the project takes precedence.

2. Using this website

You may view and use this website for lawful purposes. You agree not to attempt to disrupt it, gain unauthorised access to it, copy it systematically, or use it in a way that interferes with anyone else's use of it.

Information on this website describes the services we offer. It is provided in good faith for general information and does not by itself form an offer or a contract.

3. Our services

Webnday LLC provides digital services across four areas: brand, web, campaigns and AI solutions. Services can be engaged individually or together.

• Each engagement is set out in a written scope covering the deliverables, the schedule and the fee.
• Work begins once you have approved that scope.
• Anything not listed in the scope is outside it. Additional work is quoted and approved before it is started.
• Timelines assume that feedback, content and access requested from you arrive when agreed. Delays on that side move the schedule accordingly.

4. Your responsibilities

• Providing accurate information, content and access needed for the work.
• Reviewing and responding to work submitted for approval within the agreed timeframes.
• Making sure you have the rights to any material you supply to us, including text, images, fonts and logos.
• Maintaining your own backups and access credentials for platforms you own.

5. Fees and payment

Fees for each engagement are set out in the written scope for that engagement. Unless the scope says otherwise:

• Invoices are payable by the date stated on the invoice.
• Where a deposit or staged payments are agreed, work on that stage begins once the corresponding payment is received.
• Any taxes, bank charges or payment processing fees that apply are payable in addition to the quoted fee.
• We may pause work on an engagement while an invoice for it remains unpaid.

6. Intellectual property

The content of this website — including its text, layout, design and code — belongs to Webnday LLC unless stated otherwise, and may not be copied or reused without permission.

For client work: material you provide to us remains yours. On full payment of the agreed fees, the final deliverables produced for you under the scope transfer to you.

Two things sit outside that transfer. First, third-party components — such as fonts, plugins, stock assets, hosting and software subscriptions — remain governed by their own licences, which you hold in your own name. Second, we keep the right to use our own general knowledge, methods and reusable internal tooling on other projects; that does not include your content, brand assets or confidential information.

Unless you ask us not to, we may describe the work at a general level and show it as an example of what we do.

7. AI-assisted work

Some of our services involve AI tools and automation. Where AI is used in producing or operating a deliverable, we will say so, and outputs are reviewed before they are relied upon. AI systems can produce inaccurate results, so any AI-assisted deliverable should be checked against your own requirements before it is used in a decision that matters.

8. Third-party platforms and links

Projects often depend on third-party services such as hosting, content platforms, payment providers, email tools and AI providers. Those services are operated by others under their own terms, pricing and availability, and we are not responsible for changes they make. Any links from this website to other websites are provided for convenience and are not an endorsement.

9. Warranties and limitations

We provide our services with reasonable skill and care. Beyond that, this website and its content are provided "as is", without warranties of any kind to the extent permitted by law.

We do not guarantee any particular commercial outcome — such as a level of traffic, ranking, conversion or revenue — because those depend on factors outside our control.

To the extent permitted by law, our total liability in connection with an engagement is limited to the fees paid to us for that engagement, and we are not liable for indirect or consequential loss, including loss of profit or data. Nothing in these terms excludes liability that cannot lawfully be excluded.

10. Confidentiality

Information you share with us for the purpose of an engagement, and which is not public, is treated as confidential and used only for that engagement. The same applies to information we share with you about how we work.

11. Ending an engagement

Either party may end an engagement by written notice. If that happens, work completed and work in progress up to the date of notice remains payable, and we will hand over the completed deliverables covered by payments received. Refund treatment is set out in the Refund Policy.

12. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you use the website or agree a scope is the version that applies to it.
